When you actually need a HIPAA authorization form

HIPAA permits providers to use and disclose protected health information for treatment, payment and healthcare operations without a separate authorization. A HIPAA consent form template is required only when a disclosure falls outside those routine categories.

Typical triggers include sending records to a life or disability insurer, releasing a chart to an attorney for a personal injury claim, sharing information with an employer, or disclosing to a family member who is not the patient's legal representative.

If you are simply requesting your own chart from your doctor, a narrower medical records release form is usually the more direct document to use instead.

The six core elements of a valid authorization

The Privacy Rule sets out specific content requirements, and covered entities are expected to reject or return any HIPAA consent form PDF that leaves core elements blank or vague.

Who can sign, and what a personal representative needs

If someone other than the patient signs, the form should record their relationship and the legal basis for signing, since the recipient may ask the practice to confirm this before releasing anything.

Expiration and how revocation actually works

Every authorization needs an expiration date or a defined expiration event, such as 'end of current treatment episode.' An authorization with no end point at all does not meet the Privacy Rule's requirements.

A patient can revoke a signed authorization in writing at any time. Revocation does not undo disclosures the provider already made in good-faith reliance on the form before receiving the written revocation.

United States, United Kingdom, Canada, Australia and New Zealand compared

United States (HIPAA)

United Kingdom

There is no HIPAA authorization form in the UK. Health data is special category data under UK GDPR and the Data Protection Act 2018, and NHS records requests go through the NHS subject access process rather than a US-style form.

Canada

Australia
